1. Acceptance of Terms
By accessing or using the PeakTraining AI application, website, or related services (collectively, the "Service"), you agree to these Terms and Conditions (the "Terms"). If you are a parent or guardian agreeing on behalf of an athlete under 18, you accept these Terms for yourself and for the athlete. If you do not agree, do not use the Service.
2. Description of Service
PeakTraining AI ("Peak Training", "we", "our", "us") provides AI-assisted athletic performance tracking, video analysis, training plan generation, and coaching tools. The Service is intended as a supplement to, not a replacement for, qualified human coaching and medical guidance.
3. Eligibility and Accounts
- You must be at least 13 years old to create an account, or have verifiable consent from a parent or legal guardian if you are under 13.
- You agree to provide accurate and current information and to keep your account credentials confidential.
- You are responsible for all activity that occurs under your account.
- Parents and guardians are responsible for supervising their child's use of the Service and for managing privacy and safety settings.
4. Acceptable Use
You agree to use the Service only for lawful purposes and to respect other users. You will not:
- Upload content you do not have the right to share, or that depicts another person without appropriate consent;
- Upload illegal, harmful, harassing, sexual, violent, or abusive content, or content that endangers a minor;
- Attempt to circumvent safety features, age gates, parental controls, or access restrictions;
- Scrape, reverse engineer, or use automated means to access the Service beyond documented APIs;
- Use the Service to build or train competing AI models, or to resell our AI outputs as a standalone service;
- Interfere with the Service's security or availability.
5. Content You Upload
- You retain ownership of the videos, images, and other content you upload ("User Content").
- You grant Peak Training a worldwide, non-exclusive, royalty-free license to host, store, process, analyze, reproduce, display, and transmit your User Content solely to operate, secure, and improve the Service and to deliver features you have requested.
- You represent that you have all rights necessary to upload your User Content, including any consents required from other people who appear in it.
- You can delete your User Content at any time through the Service, subject to reasonable backup retention windows described in the Privacy Policy.
6. Video Analysis and Third-Party AI
The Service uses third-party AI providers to analyze uploaded video and generate insights. In particular, videos are processed by TwelveLabs for safety checks and athletic analysis. Analysis data is retained for 90 days and then deleted. You can request immediate deletion of analysis data by contacting support. TwelveLabs may use derived analysis signals to improve its safety detection models; it does not receive your account identity and does not use your raw video to train general-purpose models. 7. AI-Generated Recommendations
Training plans, drills, feedback, and other outputs generated by Peak Training's AI are provided for informational and training purposes only. They are not medical advice, physical-therapy advice, or a substitute for qualified human coaching. Always consult a qualified healthcare provider before starting or modifying an exercise program, especially if you have an injury, medical condition, or other risk factor. You are responsible for evaluating AI outputs before acting on them, and coaches and parents can override any recommendation.
8. Parental Controls and COPPA
- Parents and guardians control all privacy, sharing, and visibility settings for athletes under 13 and may restrict settings for older minors at their discretion.
- Privacy settings chosen by a parent are enforced across the platform, including for coaches and teammates.
- We comply with the U.S. Children's Online Privacy Protection Act (COPPA), including the 2025 FTC amendments. Parents may review, export, or delete their child's data, and may withdraw consent at any time, by contacting privacy@peaktraining.ai.
9. Intellectual Property
Peak Training, its logos, software, models, designs, and content (excluding User Content) are owned by Peak Training or its licensors and are protected by copyright, trademark, patent, and other intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your personal, non-commercial athletic-training purposes, subject to these Terms.
10. Subscriptions, Payments, and Trials
Some features require a paid subscription. Prices, billing periods, and trial terms are disclosed at checkout. Subscriptions renew automatically at the then-current rate until you cancel in your account settings. You can cancel at any time; cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that AI outputs will be accurate, complete, or suitable for any particular goal. Use of the Service is at your own risk.
12. Limitation of Liability
To the maximum extent permitted by law, Peak Training and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our aggregate liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim and (b) one hundred U.S. dollars (US$100). Some jurisdictions do not allow these limitations; in those jurisdictions our liability is limited to the maximum extent permitted by law.
13. Indemnification
You agree to indemnify and hold harmless Peak Training from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of (a) your User Content, (b) your violation of these Terms, or (c) your violation of any law or the rights of a third party. Parents and guardians are responsible for claims arising from a minor's use of the Service under their account.
14. Termination
You may delete your account at any time through Account Settings. We may suspend or terminate your account if you violate these Terms, misuse the Service, or if required by law. On termination, your license to use the Service ends, but provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
15. Changes to the Service and to These Terms
We may update the Service and these Terms from time to time. For material changes, we will provide notice through the Service or by email and, where appropriate, ask you to re-accept the updated Terms. Continued use of the Service after the effective date of updated Terms constitutes acceptance.
16. Governing Law and Disputes
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-laws principles. You and Peak Training agree to resolve disputes in the state or federal courts located in Delaware, and you consent to their personal jurisdiction — except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property or confidential information. Nothing in this section limits any non-waivable rights you have under the law of your state or country of residence.
